Welcome to Orpheos! These Terms of Service ("Terms") govern your access to and use of the Orpheos platform, website, and services (collectively, the "Services") provided by Orpheos LLC, a Wyoming limited liability company ("Orpheos," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. About Orpheos

Orpheos provides a unified interface for multiple artificial intelligence services, including but not limited to Claude, Grok, ChatGPT, Gemini, Perplexity, and others ("Third-Party AI Services"). We act as an intermediary only and do not develop or control the underlying AI models.

2. Eligibility and Account Registration

Age Requirements

You must be at least 13 years old, or the minimum age in your jurisdiction. If under 18 (or local majority age), you must have parental/guardian consent.

Account Creation

  • Provide accurate, current, and complete information
  • Maintain and update account details
  • Keep login credentials secure
  • Notify us of unauthorized use
  • Be responsible for all activities under your account

3. Description of Services

  • Unified access to multiple AI services
  • Conversation management tools
  • User experience enhancements

Service Availability

  • Free access is currently offered
  • Paid tiers may be introduced with notice
  • Availability may vary by region
  • We use our own API credentials

Usage Limits & Fair Use

We may enforce usage caps, rate limits, or restrict accounts that create excessive load.

4. Acceptable Use

You may use Services for lawful personal purposes. You may not:

  • Use Services for illegal, harmful, or abusive purposes
  • Violate laws or regulations (GDPR, CCPA, etc.)
  • Infringe on intellectual property
  • Submit unlawful, obscene, harassing, or discriminatory content
  • Generate harmful AI outputs (deepfakes, malicious code, etc.)
  • Reverse engineer, decompile, or misuse Services
  • Exceed usage limits or strain infrastructure
  • Create accounts by unauthorized means
  • Develop competing products using Services

5. User Content and Data

Your Content

You retain ownership of your content but grant us a limited license to process and transmit it.

Data Storage

  • Data stored on secure Microsoft Azure servers with AES-256 encryption
  • Content may be sent to Third-Party AI Services

Data Retention

  • Content kept while account is active
  • Conversations deletable within 30 days
  • Account deletion removes data within 30 days
  • Inactive accounts may be removed after 1 year

Use for Improvement

Aggregated, de-identified data may be used to improve Services. Future training use will include opt-out options.

6. Third-Party AI Services

Use is subject to these Terms and the providers’ terms. We make no warranties about third-party availability or accuracy. Dependencies and moderation are managed by the providers.

7. Subscriptions and Payments

Currently free. If paid tiers are introduced:

  • Notice will be given in advance
  • Billing through Stripe
  • Fees non-refundable except as required by law

8. Intellectual Property

Orpheos owns all rights to the Services. You own your User Content. AI outputs may contain risks including copyright issues—you are responsible for legal compliance.

9. Confidentiality and Data Security

We treat your content and account details as confidential. Security measures include encryption, access controls, and incident response.

11. Disclaimers and Limitations of Liability

Services are provided "as is". We disclaim all warranties. Our liability is capped at $100 or the amount paid in the prior 12 months.

12. Indemnification

You agree to indemnify Orpheos for claims arising from your use, content, or legal violations.

13. Termination

You may close your account anytime. We may suspend or terminate accounts for violations or inactivity. Key provisions survive termination.

14. Dispute Resolution

Disputes are resolved by arbitration (AAA Rules), unless small claims court applies. Class actions are waived. You may opt out within 30 days of acceptance.

15. General Terms

  • These Terms plus Privacy Policy form the full agreement
  • If a clause is unenforceable, others remain
  • We may update Terms with notice
  • No waiver of rights unless in writing
  • Assignment requires our consent (except by us)
  • Export controls and legal compliance apply
  • Governing law: Wyoming
